What is an injunction?
This is a court order that compels a person to refrain from specific acts.
A permanent injunction can be obtained by filing a lawsuit using a plaint, wherein the plaintiff prays for the same and court, after hearing the case, may grant the permanent injunction.

How to obtain a temporary injunction
  1. Apply to court using a Chamber Summons which will be presented to court.
  2. The Chamber Summons must be supported by an Affidavit stating clearly the grounds the applicant relies on for the grant of the injunction.
  3. When filing the Chamber Summons, the requisite filing fees (UGX 1,800/=) must be paid in the bank and evidence of payment attached to the application.
  4. The applicant then serves the application, after it has been sealed by court, on the respondent requiring him/her to appear in court on the day indicated on the Chamber Summons.
  5. Once the summons is served on the defendant, the plaintiff must file an affidavit of service in court clearly stating how he/she served it on the defendant.
  6. Upon receipt of the Chamber Summons, the respondent may file an Affidavit in Reply before the date on which he/she is expected to appear in court.
  7. The affidavit in reply must also be served on the applicant.
  8. On the date mentioned in the Chamber summons, court will hear both the applicant and the respondent or only the applicant where the respondent does not appear.
  9. After the hearing court will go ahead to make a ruling.

Who can apply for temporary injunction?
A person who has prayed for a permanent injunction in a main suit that is already filled before court.

Where should an application for a temporary injunction be filed?
It should be filed in the court where the main suit is already filed.

How to obtain an interim injunction
  1. Apply to court using a Notice of Motion which will be presented to court.
  2. The procedure thereafter is similar to the procedure for obtaining a temporary injunction as obove.
Who can apply for an interim injunction?
A person who has already applied for a temporary injunction.

Where should an application for an interim injunction be filed?
It should be filed in the court where the application for a temporary injunction has been filed.
