Small Claim Hearing and Judgement
On the day of the Hearing
Where the defendant files a defense and/or counterclaim then the matter will be set down for hearing. At the hearing, on the day and time of hearing it is advised that you;
- appear in person with all the relevant documents and exhibits to the claim, written statement of defense or counterclaim;
- ensure that any witness or witnesses in support of his or her claim are present in Court;
- have proof that the summons, written statement of defense or counterclaim was served upon the other party or parties.
Where the judicial
officer has heard all parties and any witness to the case, he or she shall pass
judgment, immediately after the hearing or within fourteen days after hearing the
case.
